1. Agreement

By using Gem Identifier — the app, the website, or both — you agree to these Terms of Service. If any of it doesn’t sit right with you, please don’t use the service.

2. What Gem Identifier does

Gem Identifier is an AI-powered gemstone identification tool. It analyzes your photos and returns a report covering species, variety, likely origin, likely treatments, rarity, market value range, care guidance, and historical context. It is educational and informational — it is not a gemological laboratory.

3. How to use it

• Give accurate info when you set up an account.
• Don’t upload illegal, inappropriate, or unrelated content.
• Don’t abuse the service, scrape it, or attempt to circumvent limits.
• Respect others’ intellectual property.

4. Disclaimer — please actually read this

Identification results are AI-generated opinions, not lab reports. Species, origin, treatment detection, and value estimates can be wrong — image-based AI is fooled regularly by look-alikes and hidden treatments. For any stone you intend to buy, sell, or insure, get a certified lab report (GIA, AGL, SSEF, Gubelin, GRS). Don’t rely on Gem Identifier alone for financial decisions.

5. Disclaimer Agreement

By using Gem Identifier, you also agree to the terms outlined in our AI Identification Disclaimer. The Disclaimer includes important information about the limitations of our AI-powered identifications and of every other piece of information presented on Gem Identifier — including the encyclopedia, reference pages, guides, articles, and community submissions — all of which may contain errors, omissions, or outdated information and must not be relied on as expert, safety, medical, legal, or financial advice. The Disclaimer is an integral part of these Terms, and your use of Gem Identifier is subject to your acceptance of both.

6. Encyclopedia and Reference Content

Gem Identifier may include an encyclopedia, reference pages, guides, articles, and other informational content (“Reference Content”). Reference Content is compiled and generated with the help of automated tools and AI models and is provided for general informational purposes only. It may contain errors, omissions, or outdated information, and it has not been reviewed by qualified experts. We make no representation or warranty as to the accuracy, completeness, or reliability of any Reference Content or of any other information presented on Gem Identifier, and you agree not to rely on it as a substitute for professional advice or for any decision that could affect your health, safety, property, legal rights, or finances. Images shown with Reference Content may be illustrative rather than exact matches. If you believe something is wrong, please let us know at support@gemidentifier.com and we will review it.

7. Your content

You keep ownership of the photos you upload. By uploading, you grant us a license to process them for the purpose of identifying the gem and improving our AI. Our app, model, and infrastructure remain ours. The full license you grant us is described in the section titled “License Grant to Gem Identifier” below.

8. License Grant to Gem Identifier

By using Gem Identifier and its related apps, websites, and services (the “Services”), you grant to Gem Identifier, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute any content you submit, create, or make available through the Services — including without limitation the photos and images you upload for identification; the notes, descriptions, locations, and other text you provide with them; the identifications, descriptions, estimates, and any other output produced by the Services at your direction; any collections, lists, or albums you assemble, including their names and the selection and arrangement of the items they contain; and your profile information, including your username, display name, profile picture, bio, and any links you add — regardless of whether an identification’s or collection’s visibility is public or private. This includes the right to display your uploaded photos and identifications on the community feed, on encyclopedia, species, tag, and search pages, on the websites and apps of Gem Identifier and its affiliates, and in marketing for the Services. For clarity, changing an identification’s or a collection’s visibility from public to private does not revoke or limit the license granted under this section with respect to that identification, that collection, or any content associated with it. The license granted to Gem Identifier remains in effect even after termination of this Agreement by any party, for any reason.

9. Limits of liability

Gem Identifier is provided "as is" without warranties. We’re not liable for losses that come from relying on identifications or value estimates.

10. Changes

We’ll update these terms when we need to. Continued use after an update means you accept the new version.
